Welcome to SeenKind (“SeenKind”, “we”, “our”, or “us”).

SeenKind is an online mental health marketplace that enables clients to connect with independent therapists through secure video, audio, and messaging services. These Terms of Service (“Terms”) govern your access to and use of our website located at https://www.seenkind.com, our applications, and all related services (collectively, the “Platform”).

By creating an account, browsing the Platform, booking a session, applying as a therapist, making a payment, communicating through the Platform, or otherwise using SeenKind, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and all policies referenced herein.

If you do not agree with these Terms, you must not access or use the Platform.

Platform

The SeenKind website, applications, software, messaging system, booking system, video services, payment services, and related features.

Client

Any individual seeking therapy or mental wellness services through the Platform.

Therapist

An independent mental health professional who has been approved to offer services through SeenKind.

Booking

A scheduled appointment between a client and a therapist.

Session

Any therapy or wellness consultation conducted through SeenKind using video, audio, or messaging.

Content

Text, documents, images, videos, profile information, reviews, messages, and any other material uploaded or shared through the Platform.

SeenKind is a technology marketplace.

Our role is to provide a secure platform that allows clients to discover therapists, communicate securely, schedule appointments, process payments, and attend online sessions.

SeenKind does not provide therapy, counselling, psychological treatment, psychiatric treatment, medical advice, diagnosis, or healthcare services.

Therapists using the Platform are independent professionals and are solely responsible for the services they provide.

Nothing in these Terms creates an employment, partnership, agency, or joint venture relationship between SeenKind and any therapist.

You may use the Platform only if you are legally permitted to do so under the laws applicable in your jurisdiction.

Users are responsible for ensuring that their use of the Platform complies with applicable laws.

Where parental or legal guardian consent is required for a minor to receive services, the therapist and the user are responsible for ensuring that such consent has been obtained before services are provided.

SeenKind reserves the right to refuse service or terminate accounts where required by law or these Terms.

You agree to:

• Provide accurate and truthful information.
• Keep your account information up to date.
• Maintain the confidentiality of your password.
• Immediately notify SeenKind of unauthorized account access.
• Accept responsibility for all activities conducted through your account.

You may not create multiple fraudulent accounts or impersonate another individual or organization.

To join SeenKind, therapists may be required to submit:

• Government-issued identification
• Educational qualifications
• Relevant certifications
• Professional experience
• Profile information
• Additional documents requested during the review process

SeenKind reviews submitted information before approving therapist profiles.

Approval by SeenKind confirms only that the submitted information has been reviewed in accordance with our verification procedures. It does not guarantee clinical competence, treatment outcomes, licensing status, or suitability for any particular client.

SeenKind may suspend or remove therapist accounts if submitted information is found to be false, misleading, incomplete, or inconsistent with Platform policies.

Clients agree to:

• Treat therapists respectfully.
• Provide accurate information.
• Attend booked sessions on time.
• Pay applicable fees.
• Use the Platform only for lawful purposes.
• Refrain from harassment, abuse, discrimination, threats, fraud, or other inappropriate conduct.

Clients acknowledge that therapy outcomes differ from person to person and cannot be guaranteed.

Therapists agree that they:

• Operate independently.
• Are solely responsible for the professional services they provide.
• Will maintain truthful and accurate profile information.
• Will comply with applicable laws and professional obligations.
• Will maintain appropriate standards of confidentiality.
• Will conduct themselves professionally.
• Will comply with SeenKind's Therapist Agreement, Professional Standards Policy, Code of Conduct, and all other applicable Platform policies.

Clients may submit booking requests through the Platform.

Therapists manage their own availability and determine whether to accept or decline booking requests.

Once confirmed, both parties are expected to attend the scheduled session.

Repeated cancellations, no-shows, or misuse of the booking system may result in account restrictions.

Payments for sessions are processed through Stripe or another authorized payment provider used by SeenKind.

Therapists determine their own session prices.

SeenKind deducts a 15% platform commission from completed bookings before issuing therapist payouts.

Additional payment processing fees, taxes, or currency conversion charges may apply depending on the payment method and jurisdiction.

SeenKind reserves the right to delay payouts where required to investigate fraud, chargebacks, disputes, or suspected violations of these Terms.

Clients may cancel appointments in accordance with the SeenKind Cancellation & Refund Policy.

Unless otherwise stated in that policy, clients who cancel at least 48 hours (2 days) before the scheduled session may be eligible for a refund.

Refund eligibility may vary depending on the circumstances, payment processing status, disputes, or applicable law.

Clients may leave honest reviews based on genuine experiences.

Reviews must not:

• Contain false or misleading information.
• Include offensive, abusive, or discriminatory language.
• Reveal confidential or private information.
• Be exchanged for incentives or compensation.

SeenKind may moderate, remove, or refuse to publish reviews that violate these Terms or applicable policies.

SeenKind provides secure messaging between clients and therapists.

Users agree not to use the messaging system to:

• Send spam.
• Share malware or malicious files.
• Harass or threaten others.
• Distribute unlawful content.
• Circumvent Platform security.

SeenKind may retain communication records or related metadata where necessary for security, legal compliance, fraud prevention, dispute resolution, and Platform operations, as described in our Privacy Policy.

Your use of SeenKind is governed by our Privacy Policy, which explains how we collect, use, store, protect, and disclose personal information.

SeenKind is not an emergency service.

If you or another person is experiencing a mental health crisis, medical emergency, or immediate risk of harm, contact your local emergency services or appropriate crisis resources immediately.

Therapists are responsible for complying with any professional obligations relating to emergency situations under the laws applicable to their practice.

Users must not:

• Impersonate another person.
• Upload fraudulent documents.
• Attempt unauthorized access to any account or system.
• Use automated tools to disrupt the Platform.
• Upload viruses or malicious software.
• Engage in unlawful conduct.
• Infringe the intellectual property or privacy rights of others.
• Misuse the Platform for commercial purposes unrelated to its intended use.

All software, branding, logos, trademarks, designs, graphics, text, and other Platform content are owned by or licensed to SeenKind unless otherwise indicated.

No part of the Platform may be copied, reproduced, modified, distributed, or commercially exploited without prior written permission from SeenKind.

SeenKind may integrate services provided by third parties, including payment processors, authentication providers, cloud hosting providers, analytics services, email providers, and communication services.

SeenKind is not responsible for the products, services, availability, or privacy practices of third-party providers.

SeenKind may suspend, restrict, or terminate any account where there is evidence of:

• Fraud
• False information
• Misrepresentation
• Policy violations
• Harassment
• Abuse
• Illegal activity
• Payment fraud
• Repeated complaints following investigation

Termination does not affect any legal rights or obligations that arose before termination.

The Platform is provided on an “as is” and “as available” basis.

SeenKind does not guarantee uninterrupted access, error-free operation, therapist availability, or any specific therapeutic outcome.

To the fullest extent permitted by applicable law, SeenKind shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of the Platform.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

You agree to indemnify and hold harmless SeenKind, its owners, directors, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Platform, your violation of these Terms, or your infringement of the rights of any third party.

SeenKind may update these Terms from time to time.

Where changes are material, we will provide reasonable notice through the Platform or by email where appropriate.

Continued use of the Platform after the effective date of updated Terms constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of the Islamic Republic of Pakistan, without prejudice to any mandatory consumer protection rights that may apply under the laws of a user's jurisdiction.
