Session Recording Policy

Therapy sessions are private by default. This Policy explains when recording is and is not permitted — and what happens if those rules are broken.

Default: Sessions are not recorded by SeenKind. Recording by clients or therapists requires informed consent from every participant and must comply with applicable law.

Secret recording is prohibited. Unauthorized recording may result in permanent removal from the Platform and legal action. See Section 5.

Purpose

This Session Recording Policy explains the rules governing the recording, storage, use, and sharing of therapy sessions conducted through the SeenKind Platform.

Protecting the privacy and confidentiality of therapy sessions is a fundamental principle of SeenKind.

This Policy should be read together with the:

General Rule

By default, therapy sessions conducted through SeenKind are not recorded by the Platform.

SeenKind does not routinely audio-record or video-record therapy sessions.

Recording by Clients or Therapists

Clients and therapists must not record any therapy session — whether by video, audio, screenshots, screen recording, or any other method — unless both of the following conditions are met:

  • Every participant has provided informed consent before recording begins; and
  • The recording is permitted under the laws applicable to all participants.

Where consent is legally required, silence or continued participation does not constitute consent.

Platform Features

If SeenKind introduces an optional recording feature in the future:

  • Recording will only occur after all required consents have been obtained.
  • Users will be informed when recording is active.
  • Users may be asked to acknowledge additional terms before using the feature.

SeenKind reserves the right to discontinue or modify any recording feature at any time.

Unauthorized Recording

Prohibited

The following activities are prohibited:

  • Secretly recording sessions.
  • Recording without the required consent.
  • Using third-party software to secretly capture sessions.
  • Taking screenshots intended to expose confidential therapy discussions.
  • Recording another participant without their knowledge where prohibited by law.

Unauthorized recording may result in:

  • Account suspension.
  • Permanent account termination.
  • Removal from the Platform.
  • Legal action where permitted by law.

Sharing Recordings

Where a session has been lawfully recorded with all required consents, users must not publish, distribute, upload, stream, or otherwise share the recording without the permission of all individuals whose information or likeness appears in the recording, unless disclosure is required or permitted by applicable law.

This includes sharing recordings on:

  • Social media.
  • Video platforms.
  • Messaging applications.
  • Websites.
  • Forums.
  • Artificial intelligence tools or services.
  • Public or private cloud storage intended for third-party access.

Confidentiality

Therapy sessions often involve highly sensitive personal information.

Users should respect the privacy of all participants and take reasonable steps to prevent unauthorized access to any lawfully created recordings.

Therapists remain responsible for complying with any confidentiality obligations imposed by applicable law and professional standards.

Storage of Recordings

Where users lawfully create recordings outside the SeenKind Platform, they are solely responsible for:

  • Secure storage.
  • Access controls.
  • Backup practices.
  • Compliance with applicable privacy laws.
  • Compliance with professional obligations.

SeenKind is not responsible for recordings created, stored, or shared outside the Platform.

Use in Complaints or Legal Proceedings

Users may provide lawfully obtained recordings to SeenKind as part of a complaint or investigation where appropriate.

SeenKind may decline to review recordings that appear to have been obtained unlawfully or in violation of this Policy.

Nothing in this Policy limits any rights or obligations under applicable law regarding the use of evidence in legal proceedings.

Respect for Therapy

Therapy depends on trust, openness, and confidentiality.

Users are encouraged to focus on the therapeutic process rather than creating recordings, except where there is a legitimate and lawful reason to do so with the informed consent of all participants.

Violations

Violations of this Policy may result in one or more of the following actions:

  • Educational guidance.
  • Written warning.
  • Removal of uploaded content.
  • Temporary account restrictions.
  • Suspension.
  • Permanent account termination.
  • Reporting to relevant authorities where required or permitted by law.

SeenKind will determine the appropriate response based on the circumstances and available evidence.

Changes to This Policy

SeenKind may update this Session Recording Policy from time to time.

The latest version will be published on the Platform with a revised version number and effective date.

Continued use of SeenKind after changes become effective constitutes acceptance of the updated Policy.
